2 gunmen at large after robbing bank in northwest Dallas

Two armed men are at large after robbing a Capital One bank Wednesday in northwest Dallas.

The robbery happened about 10:15 a.m. at the bank in the 5300 block of Forest Lane, police said. One of the gunmen jumped over the teller’s counter and demanded money.

The second man forced employees seated in the lobby to walk over to the teller’s counter, and then both robbers fled on foot with an undisclosed amount of money.

One man is described as black, about 5 feet 8 and wearing all black, including a black ski mask.

The second man is described as black, in his mid-20s, about 6 feet tall and about 200 pounds. He was wearing a purple long-sleeve hoodie, gray cap and white sweatpants, police said.

Waffle House Shooting Hero James Shaw Jr. Raises $165,000 For Victims

Just hours after he pried a rifle from a gunman who’d opened fire at a Waffle House in Tennessee, James Shaw Jr. launched a fundraiser to help the victims’ families.

That GoFundMe campaign by Thursday afternoon had raked in just under $165,000 — 11 times its goal — since the attack Sunday left four people dead.
Meantime, the Antioch, Tennessee, restaurant has pledged to donate all its proceeds for the next month to the families of the deceased and living victims. A New York man launched an online fundraiser to benefit Shaw that had raised $175,000 from more than 5,500 donors. Tennessee lawmakers this week also paid tribute to Shaw, 29, for his heroism and his compassion for the victims. The state General Assembly officially recognized his heroism, along with his “penchant for honesty,” in a joint resolution. “You are my hero,” state Rep. Jason Powell said, “and Tennessee’s hero.”
Shaw was sitting with a friend at the Waffle House counter when a gunman wearing only a green jacket opened fire outside the diner, police said. Shaw bolted from his seat and slid along the ground to the restroom, he recalled. He kept an eye out for the gunman, and as soon as there was a pause in the shooting, Shaw ambushed him. “I figured if I was going to die, he was going to have to work for it,” he told reporters Sunday. The barrel of the rifle was still hot when Shaw managed to wrestle it away, he said. He tossed it behind the counter, and the gunman fled. The encounter left Shaw with a burn on his hand and a wound on his elbow where a bullet grazed it. Nearly 36 hours later, police arrested alleged shooter Travis Reinking. He’s charged with four counts of criminal homicide. He also faces four counts of attempted murder and one count of unlawful gun possession in the commission of a violent felony.

Dick’s Sporting Goods Will Destroy Unsold Assault-Style Weapons

Almost two months after Dick’s Sporting Goods announced they will no longer be selling assault-style weapons, the company announced it is destroying the unsold stock.

“We are in the process of destroying all firearms and accessories that are no longer for sale as a result of our Feb. 28 policy change. We are destroying the firearms in accordance with federal guidelines and regulations,†the company said in a statement to ABC News.

In late February, two weeks after the shooting at Marjory Stoneman Douglas High School in Parkland, Florida, Dick’s Sporting Goods announced that they would no longer sell assault-style rifles or high capacity magazines. The company also said it would no longer sell firearms or ammunition of anyone under the age of 21 years old.

“Following all of the rules and laws, we sold a shotgun to the Parkland shooter in November of 2017. It was not the gun, nor type of gun, he used in the shooting. But it could have been,†the company said in February.

Dick’s Sporting Goods had already removed all assault-style rifles from all Dick’s stores after the Sandy Hook shooting but removed them from sale at all 35 Field and Stream stores following the shooting in Parkland.

In an interview with George Stephanopoulos on Good Morning America, Dick’s Sporting Goods Chairman and CEO Edward Stack said, “We’re staunch supporters of the Second Amendment. I’m a gun owner myself. We’ve just decided that based on what’s happened with these guns, we don’t want to be a part of this story and we’ve eliminated these guns permanently.â€

Remington Files For Bankruptcy


Remington, one of America’s oldest firearms makers, files for bankruptcy protection

Remington, one of the nation’s oldest gun manufacturers, filed for bankruptcy court protection late Sunday amid heavy debts, falling sales and the potential for adverse court rulings stemming from the 2012 Sandy Hook school massacre.

Remington Outdoor and its subsidiaries submitted a Chapter 11 petition to the federal bankruptcy court in Delaware, outlining a restructuring plan that would maintain the company’s operations, continue pay and benefits for employees and ultimately turn the operating control of the company to creditors.

The agreement would end the controlling financial interest of Cerberus Capital Management, the private equity company that acquired what was then known as Remington Arms, for $118 million in 2007. Cerberus unsuccessfully tried to sell the company before the decision to seek bankruptcy protection.

Madison, N.C.-based Remington, a maker of shotguns, rifles and handguns since 1816, listed liabilities between $100 million and $500 million, with an identical estimate of assets. Billed as “America’s Oldest Gunmaker,” the company’s brands include Remington, Bushmaster Firearms and DPMS/Panther Arms.

Remington initially announced the pre-agreed bankruptcy plan on Feb. 12. But the actual filing was delayed after the Feb. 14 mass shooting that killed 17 people at Marjory Stoneman Douglas High School in Parkland, Fla. The filing came hours after student-led rallies across the nation cited the massacre in calling for stricter gun control laws.

Remington will continue to operate while it pursues Chapter 11 bankruptcy protection, a procedure that gives financially ailing companies time to devise reorganization plans to stay afloat, shed debt, and at least partly repay creditors.

The deal announced in February said Remington would be able to write off $700 million of $950 million in estimated debt. The agreement would also provide $145 million of new capital for its operating subsidiaries and provide $100 million in creditor-funded money as a debtor-in-possession term loan, the company said at the time.

Stephen Jackson, Remington’s chief financial officer, said in a bankruptcy declaration that the company and its subsidiaries have held leading U.S. market positions in a variety of firearms and ammunition categories since 2008 — including sales to military and law enforcement agencies.

However, along with the company’s debts, he cited a series of financial setbacks over roughly the last one-year period.

Remington increased production rates during 2016, based on expected consumer demand in 2017, but that demand “ultimately did not materialize,” Jackson stated.

Simultaneously, the firearms and ammunition markets faced competitive market pricing pressure from higher inventory levels industry-wide, along with “accelerating reduction in demand,” he said.

Remington borrowed to ramp up production to meet expected sales that fell below expectations. Additionally, the company faced significant market pressure from competitors that engaged in “unusually heavy discounting and promotions to reduce their own excess inventory,” Jackson stated.

Although Remington negotiated for minor borrowing relief, “the overall business and industry environments continue to cause significant financial hardship,” added Jackson.

In interviews on Monday, some independent gun dealers said they were unsurprised by the bankruptcy filing. Although Remington’s rifles and shotguns are well regarded, the dealers said the company focused its attention on big-box stores, and then those retailers started pulling out of the market.

“Remington bet on the wrong horse,” said Justin Anderson, the marketing director for Hyatt Guns in Charlotte, which advertises itself as the nation’s single-largest gun store. “They turned their backs on shops like ours.”

There are no federal statistics on nationwide gun sales that might show industry slumps affecting Remington and other firearms makers.

However, statistics from the FBI’s National Instant Background Check System (NICS) show that the total of all types of background checks fell nearly 8.4%, to roughly 25.2 million, in 2017, the year of President Trump’s inauguration.

Firearms background checks increased steadily during much of President Obama’s two-term White House tenure, as well as during President George W. Bush’s second White House term, the data show.

A caveat with the data states that “a one-to-one correlation cannot be made between a firearm background check and a firearm sale.”

Separately, U.S. firearms manufacturing increased 43%, to more than 9.3 million weapons, from 2011 through 2015, according to data issued by the U.S. Department of Justice’s Bureau of Alcohol, Tobacco, Firearms and Explosives.

In all, 3.6 million rifles and 3.5 million handguns were manufactured in the U.S. in 2015 the data showed. Rifle manufacturing was up 9% from 2014, while the number of pistols manufactured was down roughly 2% during the same one-year period, the data showed. 

Owners of some gun shops saw a rush of firearms purchases in the months leading up to the 2016 presidential election, when polls predicted that Democratic presidential nominee Hillary Clinton would likely win the White House.

Apart from industry sales trends, Remington’s reputation and financial outlook took a hit after law enforcement authorities confirmed that Adam Lanza used one of the company’s Bushmaster XM15-E2S guns in the Sandy Hook Elementary School massacre in Newtown, Conn. Lanza killed his mother and then fatally shot 26 children and educators.

Survivors and families of the victims subsequently sued Remington under legal liability theories that could enable the lawsuits to proceed despite federal legislation that blocks most such actions against gun manufacturers.

After litigation in federal court, the Sandy Hook plaintiffs recently made it to the Connecticut Supreme Court, where both sides in the case and the firearms industry await a ruling. “There’s no certainty that they would win, there’s also no certainty that they’re going to lose at this stage,” Heidi Li Feldman, a Georgetown University law professor, said of the plaintiffs during a Monday interview.

Parkland School Shooting Survivor Speaks In Dallas

DALLAS – The conversation about gun rights and school safety continued over the weekend, well after the nationwide march.

One Parkland school shooting survivor, 17-year old Justin Irwin, spoke at the Lovers Lane United Methodist Church in Dallas.

Justin said he stands by the second amendment, but he also wants to see new laws put into place, including raising the age of purchase to 21, tightening red flag laws, stronger background checks and banning bump stocks.

A couple of years ago, Justin lost a grandfather who served in the Vietnam war, and it helped him realize just how important fighting for the country is… that`s why he plans to join the ROTC or a military academy, and to own a gun when he`s legally able.

“The main thing I want to do is I want to be able to help people,” Irwin said. “And I love America, I want to protect my country, fight for the people who can’t fight, protect them, do whatever I can do to help out people… I’m not against guns at all, like if you want guns, I believe you should be able to get them as long as you have no issues in your background, and no mental illnesses and you know how to use it right and you’re trained, and once you have all the background checks, which need to be improved upon, the ones that we have now, but as long as you pass on that, I think you should be able to use the guns that you want.”

Saturday`s March for Our Lives took place in many cities around the country, and the other speaker at the event took part in a march in Fort Worth.

Anden Suarez spoke about what she feels Christians and communities of faith need to recognize, when it comes to gun violence in the U.S.

“We live in a country that is in the middle of a devastating culture of gun violence,” Suarez said. “The number of deaths is unprecedented. And as a community we need to recognize that, we need to address that culture, we need to address it with legislation but we also need to give it our attention, but we also need to give it our vote, we have to give it our time, our prayers, our thoughts, and our action. And that’s what it comes down to, is recognizing that it’s not just about one law or one bill, as much good as that will do, and as much as we should advocate for legislation reform, we have to look and reflect on our culture, why it is like that and how we can amend it.”

Justin is on the swim team at marjory stoneman douglas And he lost one of his best friends in the shooting, team co-captain, 17-year old Nicholas Dworet, who would have turned 18 on Saturday.

At the march in D.C., the crowd sang “Happy Birthday” to him out of respect.

Gun control is one of the most polarizing issues in U.S. society. For nearly a century, legislation and U.S. Supreme Court cases have shaped federal gun policy. Following are some pivotal moments in that history:

1871 —The National Rifle Association is formed by two Union veterans who were disappointed by the lack of marksmanship by their troops. The goal of the group was to “promote and encourage rifle shooting on a scientific basis,” one of the veterans wrote in a magazine editorial, according to the NRA.

1927 — Congress passes the “Nonmailable Firearms Act of 1927, making it illegal to use the U.S. mail to ship “pistols, revolvers, and other firearms capable of being concealed on the person.” Exceptions were made for military, police and other official purposes. The penalty for violations was up to two years in prison and/or a fine of up to $1,000.

1934 — The National Firearms Act, the first comprehensive federal gun control legislation, is enacted, aimed at cracking down on the bloody gangland era of Al Capone, John Dillinger and others. The law imposed a $200 tax, which was considered prohibitive at the time, on machine guns and shotguns and rifles with barrels shorter than 18 inches. It also required the federal registration of these types of firearms. The act was part of President Franklin Roosevelt’s “New Deal for Crime.”

1938 — The Federal Firearms Act of 1938 takes effect, requiring firearms licenses for gun dealers, manufacturers and importers. It compelled sellers to keep customer records and banned sales to some people, including convicted felons.

1939 — The U.S. Supreme Court, in U.S. v. Miller, rules that a short-barrel shotgun is not a weapon protected under the Second Amendment.

1968 — The assassinations of President John F. Kennedy, the Rev. Martin Luther King and Sen. Robert Kennedy lead to the Gun Control Act of 1968. It created new categories of firearms crimes, banned the sale of firearms and ammunition to felons and other prohibited groups of people, and imposed federal jurisdiction over “destructive devices,” including bombs and grenades, according to the Bureau of Alcohol, Tobacco, Firearms and Explosives.

1986 — The Firearm Owners’ Protection Act amends the 1968 law, relaxing some gun control measures. It limited ATF inspections of sellers to once a year, repealed some record-keeping requirements for the sale of ammunition, prohibited the government from establishing a national registry of gun owners, and permitted gun dealers, importers and manufacturers to do business at temporary locations, such as gun shows.

1993 — The Brady Handgun Violence Prevention Act of 1993 requires federal background checks before a firearm can be purchased from a federally licensed dealer, manufacturer or importer. The National Instant Criminal Background Check System, which is maintained by the FBI, conducts the checks. The law is named after James Brady, who was seriously wounded in an assassination attempt on President Ronald Reagan in 1981 when he was serving as White House press secretary. Reagan and two others also were shot. Brady died in 2014.

1994 — Congress passes a 10-year ban on the manufacture, transfer and possession of new semi-automatic assault weapons. The ban was part of the Violent Crime Control and Law Enforcement Act of 1994, which also banned certain large capacity ammunition magazines. The measure applied only to weapons manufactured after the ban was enacted, and it expired in 2004. Numerous efforts to renew it have failed.

2003 — The Tiahrt Amendment, proposed by Todd Tiahrt, a Kansas Republican, bars the ATF from publicly releasing information about where criminals bought their firearms.

2005 — President George W. Bush signs the Protection of Lawful Commerce in Arms Act, prohibiting gun manufacturers and dealers from being named in civil lawsuits in federal and state courts when crimes are committed involving their firearms.

2008 — In the District of Columbia v. Heller, the U.S. Supreme Court rules that Americans have a constitutional right to keep handguns and commonly used firearms in their homes for self-defense. The ruling struck down the District of Columbia’s 32-year handgun ban as incompatible with gun rights under the Second Amendment.

Concealed Carry Permit Holder Kills Alleged Carjacker

A Wisconsin man, using a gun licensed under a concealed-carry permit, shot and killed an alleged carjacker in his company’s parking lot, a city official said.

The unidentified employee, 24, had just arrived for work at Milwaukee Machine Tool Corp., shortly before 6 a.m. Monday when a man named Carlos Martin, 21, allegedly attempted to carjack him with a gun, Milwaukee city alderman Cavalier Johnson told ABC News.

Police have provided few details.

The Machine Tool worker had a concealed-carry permit, Johnson said, and used his legal weapon to shoot Martin, who died from his injuries.

The debate over concealed-carry weapons and the virtues of the “good guy with a gun†has been reignited after the high school shooting in Parkland, Florida, this month killed 17 students and educators.

While people who have concealed-carry permits are trained to deal with the consequences of taking a life, that’s never the intent, according to concealed-carry permit trainer and gun expert Dean Hazen of Urbana, Illinois.

“It’s a terrible thing, the worst thing you can possibly do in your life with never-ending consequences,†the retired police officer said. “The intent is never to kill anybody. The intent is to stop the threat. Whether they live or die is not up to you.â€

But intent or no intent is beside the point for Johnson, the Milwaukee alderman.

“I think that whether it is mass shootings or what we have here, the root cause is trying to make sure that people who shouldn’t have guns don’t have them in the first place,†he said.

The Milwaukee Medical Examiner did not immediately respond to ABC News’ requests for results of Martin’s autopsy.

Police said the shooter is cooperating with their investigation, after which the Milwaukee District Attorney’s office will review the case and decide whether to bring any charges.

Milwaukee Machine Tool declined to comment on the shooting.

Trump considers raising purchase age for certain firearms, amid gun control talks

 

President Trump is signaling an openness to the idea of raising the minimum age for purchasing certain firearms in the wake of last week’s school shooting in Parkland, Fla., where a 19-year-old is accused of killing 17 teachers and students with an AR-15 rifle.

A White House source told Fox News that Trump is open to a number of measures to address mass shootings, including supporting a rise in the minimum age for owning certain firearms – a proposal that could face resistance from gun rights groups, like the National Rifle Association.

According to the Giffords Law Center, which tracks gun laws and advocates for more restrictions, licensed firearm dealers under federal law cannot sell handguns to people under 21 and cannot sell long guns to people under 18. Some state laws already impose stricter minimum age requirements.

It’s not clear if Trump would seek changes to federal laws, the source said, or if he would advocate for a change at the state level.

The Washington Post reported that Trump is considering arguments that the minimum age for buying any semiautomatic weapon should be raised from 18 to 21. Axios also reported that Trump has been telling associates that he “doesn’t think high school kids should be able to buy guns.â€

During Tuesday’s White House briefing, Press Secretary Sarah Sanders was asked about raising the age for buying AR-15s and said, “I think that’s certainly something that’s on the table for us to discuss, and that we expect to come up over the next couple of weeks.â€

She said the administration is working to determine what can be done at the federal level.

“I know there are currently laws in place in certain states that restrict that,†she said. “In terms of whether or not we make that federal policy, that hasn’t yet been determined.”

The NRA has not yet publicly commented on the trial balloon. But the discussion could be a test for Trump’s loyal base, as many of his supporters generally oppose new restrictions that would affect law-abiding gun owners. Yet Trump has flouted traditional conservative positions in the past, and could be testing whether he could sway certain wings of the party.

At the same time, he may be wary of going too far.

The talks come as the NRA’s executive vice president, Wayne LaPierre, is expected to address conservative activists at the annual Conservative Political Action Conference outside Washington this week.

Trump, who was backed by the NRA during the 2016 election, has expressed support for the Second Amendment and said he’s against reflexive gun control measures that wouldn’t stop tragedies.

But since last week’s shooting, the president has begun to embrace new gun restrictions.

Trump on Tuesday directed Attorney General Jeff Sessions to craft new regulations to ban firearm modifiers including the “bump stock†used in the Las Vegas massacre.

A memo, released by the White House on Tuesday, directs the DOJ to propose a rule “banning all devices that turn legal weapons into machineguns.â€

Sanders said the White House hasn’t “closed the door on any front†when it comes to trying to stop mass shootings and said Trump supports efforts to improve the federal background system.

Trump on Tuesday tweeted, “Whether we are Republican or Democrat, we must now focus on strengthening Background Checks!â€

The president on Wednesday is hosting parents, teachers and students at the White House to discuss efforts to ensure safety at schools.

Among those attending will be members of the Parkland community and those affected by the Sandy Hook and Columbine school shootings, the White House said.

Texas Attorney General Issues Opinion on Guns in Texas Churches

On Thursday, December 21, Texas Attorney General Ken Paxton issued the following opinion in regards to guns and security teams in Texas churches:

“Licensed handgun owners can legally carry loaded weapons into Texas churches that do not have posted signs banning weapons, Attorney General Ken Paxton said in a legal opinion released today. The opinion also clarified that a new law passed this year by the Legislature exempts churches from state fees for creating volunteer security teams.

Lieutenant Governor Dan Patrick requested the opinion on December 1, and asked Attorney General Paxton to expedite his responses “so that churches may know what legal options they have to improve security†in the aftermath of the Sutherland Springs tragedy.

“If a church decides to exclude the concealed or open carrying of handguns on the premises of church property, it may provide the requisite notice, thereby making it an offense for a license holder to carry a handgun on those premises,†Attorney General Paxton wrote in his opinion. “However, churches may instead decide not to provide notice and to allow the carrying of handguns on their premises. Unless a church provides effective oral or written notice prohibiting the carrying of handguns on its property, a license holder may carry a handgun onto the premises of church property as the law allows.â€

Senate Bill 2065, which took effect September 1, exempts churches from state fees private institutions must pay to form their own security forces. The legislature ended the fees because they imposed a significant financial burden on smaller churches.

“The regulations of the Private Security Act, including the fees required thereunder, do not apply to Texas churches when providing volunteer security services consistent with the requirements of section 1702.333 of the Occupations Code,†Attorney General Paxton concluded.

Armed Men Rob Customers at DFW Fast Food Restaurant

– Police in Terrell are looking for the men who robbed a Whataburger at gunpoint. The men ordered customers to the ground and took cash from the registers on New Year’s Day. They fled in a light grey or smoky blue four-door sedan, possibly a Nissan Altima. The next day there was a similar robbery at a Whataburger in nearby Forney.

No one was hurt in either robbery.

Situations like this can happen at anytime, so it’s important to have a sense of situational awareness. It’s also another reminder why personal self defense and having a license to carry can help give people a fighting chance when faced with danger.
